Lotus Fiduciary Services provides the difficult and time consuming services to care for the financial and other well being interests of those who no longer have the skill or capacity to do that for themselves. Often appointed by the court, following the law and ethically managed expectations, this company is often required to navigate difficult family dynamics, but do so, always, in the best interest of the individual they have been entrusted to their care. I would not recommend Lotus Fiduciary Services. They made a $111,000 mistake and tired to charge me to correct it, they are rude and they over charge for every little thing.

They were overseeing my dad’s finances and filed at tax return in 2020. The return showed that my dad owed $101,993 to the IRS. I quickly reviewed the return and noticed their CPA missed depreciation on properties my dad owned. The amended return based on the mistake I found and paid my own CPA to correct resulted in a $9,142 refund - a net difference of $111,135.00. I would not expect a professional fiduciary to make an error of this magnitude. They never even thank me for finding this error, in fact they attempted to charge us $450 for the amended return.

When I requested the refund of the $450.00 for the amended return I received a very rude response (Note this was after my fathers passing):

I would request that you refund the $450.00 for the preparation of the timeline.   That fact is none of this would have been necessary if the CPA would have filed the correct return in the first place.   The oversight by the CPA would have cost the estate $111,135.   I feel as though the CPA should be responsible for these costs as it is their mistake that caused all of this additional work.

Well, appreciation does not pay the bills and cost associated with administering the estate.

Not only do they not seem to have the expertise to identify issues they also nickel and dime on every expense. Years after my father’s death they continued to charge $25 a month to check mail. At this time there was no mail coming in.

I am writing this letter to give my experience with Lotus. We were faced with hiring a fiduciary as our dad‘s disease got worse and his wife was financially taking advantage of him, stealing his money and assets. We hired Lotus to be the custodian of our father’s finances and trusted it would be in good hands.

Being in a position needing to find a fiduciary, our family was under a stressful and emotional situation. With our dad’s declining health and his wife taking advantage of him financially we needed professional help. Hiring a fiduciary was not something that we were familiar with or had experience with. We felt we did our homework and had found a company that we could trust and put our father’s lifetime of savings and investments with to protect and manage for him.

During our time with Lotus starting in 2017 -2024 there were two owners. My review will be with the current owner and her staff. From the mission statement on their website, I did not feel as if we were treated in a responsive, professional way and certainly not as a member of their family. I would say communication (slow or no) is the biggest issue I had with them. My expectation from their mission statement and conversations with the owner was that we would be informed in a timely manner meaning month-to-month statements , emails and phone calls as needed. The monthly statements were very consistently late by two or three months. If I was concerned or had a question, I would email them and most often received no response or a very delayed response with excuses for why I was not replied to. It was the lack of ownership of problems that would arise that was so disappointing and through our eight year relationship, I only received one phone call from the owner. And in my opinion there were numerous occasions that would have warranted a call to connect with me, to inform me of what was happening with my father‘s account. what to expect after his death and finally what the process would be on the closing of his account.

The owners lack of attention to our father and family that chose Lotus to help us through this difficult part in our life was disappointing, frustrating and an additional irritation for our family to manage. I would not recommend them for reliable communication, support , trust and follow through. Here is an example ,after our father‘s death, Lotus was charging our dad's account for months after his death for numerous items that were not relevant or justified. The only reason they ceased to charge us was because I brought it to their attention and they agreed to stop. I truly believe had I not brought to their attention, we would’ve been charged going forward. I lost trust then and it was never earned back over the years since.

Hiring a fiduciary is a situation that no one has a lot of experience with and from what we learned once you have made the decision, it is very difficult to undo. It requires going to court with your person who in our case mentally was incapable to be in that situation.

Be careful who you hire and know what you’re getting into, ask a lot of questions. I in good conscience, I would not recommend or trust Lotus. I wish you luck in finding and choosing the right fiduciary for your family.
